Terms of service

These terms govern your use of the First Six app. Please read them, especially the part about wellbeing and emergencies. By using First Six, you agree to them.

1. Who provides First Six

First Six is operated by First Six Technologies Pty Ltd (ACN 699 938 817, ABN 19 699 938 817), trading as First Six ("First Six", "we", "us"), registered in Queensland, Australia. First Six is made available to you by your university, which arranges and pays for the service on your behalf. Your use of the app is also subject to your university's own policies.

2. Who can use it

First Six is provided to students by their university and is intended for tertiary students. You may use it if your university has enrolled you and you sign in with your university account. You are responsible for keeping your university sign-in secure; because we never hold your password, protecting that login protects your First Six account.

3. What First Six is (and is not)

First Six helps you through your first six weeks: what matters each week, your timetable and events, a weekly wellbeing check-in, and a way to ask your university's support team for help.

First Six is not a medical or emergency service

First Six is a wellbeing companion and a way to reach your university's support team. It is not a medical device, a counselling service, or an emergency service, and it does not provide diagnosis, assessment, or treatment. It is not monitored in real time and cannot guarantee that a message is seen immediately. If you are in danger or need urgent help, call 000, or contact Lifeline on 13 11 14. Using the app is not a substitute for professional or emergency care.

4. Your account and sign-in

You sign in through your university's single sign-on. Your university can grant or revoke your access at any time by managing that identity. Sign out on shared or lost devices; signing out ends the session on that device. If you cannot reach a device that is still signed in, contact your university or privacy@firstsix.com.au and we can end your active sessions.

5. Acceptable use

When you use First Six, you agree not to:

  • use it for anything unlawful, or to harass, abuse, or harm another person;
  • impersonate someone else or misrepresent who you are;
  • try to access data that is not yours, probe or breach the app's security, or circumvent access controls;
  • disrupt or overload the service, or use automated means to scrape it; or
  • misuse the help or crisis features, for example by submitting knowingly false crisis reports.

The help and crisis pathways exist so real people can support real need. Please use them in good faith.

6. Your content

Some things in the app are yours: your workspace notes and tasks, the timetable items you add, and what you write in a check-in or help request. You keep ownership of what you create. You grant First Six and your university the permission needed to store and process that content in order to provide the service and support you, as described in the privacy policy. Your university, as the data controller, is responsible for its own staff's handling of your information.

7. Availability

We work to keep First Six available and reliable, and we publish uptime on our status page. Even so, the service is provided on an "as is" and "as available" basis. We may occasionally need to suspend it for maintenance, updates, or to protect its security or integrity, and features may change over time.

8. Suspension and termination

Your access is tied to your enrolment and your university's arrangement with First Six. Your university can end your access, and we may suspend or limit access where it is necessary to comply with the law, protect people, or protect the security or integrity of the service. If the arrangement between First Six and your university ends, your access ends, and data is handled as set out in the privacy policy and the agreement between First Six and your university.

9. Intellectual property

First Six, including its software, design, and content we provide, belongs to First Six Technologies Pty Ltd or its licensors. These terms do not transfer any of those rights to you beyond the permission to use the app as intended. Content your university publishes in the app belongs to your university.

10. Disclaimers and limitation of liability

To the extent permitted by law, First Six is provided without warranties beyond those that cannot lawfully be excluded. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Where our liability for a failure to comply with such a guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again. To the maximum extent permitted by law, we are not liable for indirect or consequential loss.

This does not limit anything about your safety: if you are at risk, the guidance in section 3 applies and you should seek emergency help directly.

11. Changes to these terms

We may update these terms. When we do, we will change the effective date above and, for significant changes, let you know in the app or by email. Continuing to use First Six after a change means the updated terms apply.

12. Governing law

These terms are governed by the laws of Queensland, Australia, and you and First Six submit to the non-exclusive jurisdiction of the courts of that place.
